Jo Ann K. Nilges' lawsuit said The Bullet Hole of Overland Park, Kan., was responsible for her son's death during the April 2007 Ward Parkway Shopping Center shootings. Her son, Luke Nilges of Shawnee, and another person were gunned down by David Logsdon in the mall's parking lot before Logsdon was shot and killed by a police officer.
Police said Logsdon, a former security guard, went on a shooting rampage in the mall parking lot where he shot and killed Nilges and another woman, Leslie Noble Bellew.
The Jackson County lawsuit contended that the gun shop was negligent because before Logsdon made it to the mall, he purchased bullets at the Bullet Hole using the credit card of a woman police said he had killed days before.

OMG, please pick me for the jury, PLEASE God! I am begging.
How stupid is this. Alright, my Aunt died of Diabetes, I should sue the needle company because apparently when she took the Insulin through those needles, it still allowed the diabetes to kill her. Good Lord!
The attorney that took the case should be disbarred and I hope the bullet hole sues her for defamation afterwards and for legal fees to defend against her STOOPID case.:mad::mad::mad::mad:

What's sad is some Judge likely had to approve the case to be heard. I'd hope they're not on the bench long...The lawyer is just doing his job.

Judge does not have to run for election or re-election so he/she can do what they want, can you say Activist?:mad:

He used a stolen credit card to buy stuff. That's not frivolous. If he used it somewhere else and they are only suing the gun store, then it is frivolous.

OK, so maybe they're partially responsible, but not wholly. Who's to say he couldn't have went anywhere and bought bullets? Who's to say the death would not have happened had he not had bullets?
Even proving partial responsibility should be pretty tough...The only thing they're guilty of is allowing credit card fraud, nothing more.

No argument there. They didn't pull the trigger and they are in no way, shape, or form repsonsible for the deaths.
How would you guys feel if a middle-easterner bought bullets using a credit card with, like, Sally Smith's name on it and then went on a shooting spree?
My guess is that they knew this guy since he already had guns and stuff over the years so they didn't think to check the credit card's name. That is going to cost them.
Since it's gun related, this mistake could cost all of us since the gun banners love to run these things to ridiculous lengths.

There are different rules for different CC companies. I can let my wife use my Visa card, even though it is in my name. I know this from working for a rental car company. It drove me crazy when someone showed up with a CC in someone of the opposite sex's name. I called the CC company and they said no problem, so from that point I only bothered with CCs that the machine said to pick up and cut up, then I got my $50 reward check mailed to me a week later.:D

hell, lets sue the silverware makers for making people fat while we are at it.

Now there's an idea! Don't forget TV mfgs for making something that allows people to sit in front of and watch or play video games on therefore cutting down on or eliminating exercise time.
