The Missouri State Highway Patrol is investigating a crash that killed a 20-year-old Warrensburg man early New Year’s Day.
The wreck was reported at 12:15 a.m. Thursday at Southeast County Road Y and Southeast 171st Road in rural Johnson County, Missouri.
Joshua T. Gregg was a passenger in a vehicle that was going too fast for a curve, overturned and struck a pole, according to a preliminary report from the highway patrol.
Gregg, who was thrown from the vehicle, was flown to a Kansas City hospital, where he died. He was not wearing a seat belt, according to the report. Link (http://www.kansascity.com/news/breaking_news/story/962518.html)

Ok, I understand that the driver may have been driving to fast, maybe even recklessly but since the passenger didn't have is seat belt on I don't understand how they can charge the driver with the passengers death. Wasn't it the kids decision to not wear a seatbelt?

But, if he had been wearing a seat belt, would he have not died?

You can pretty much ensure he would not have died had the driver not been speeding and wrecked.

Besides, any time you are in the position of driving with passengers, you become responsible for your passengers lives.

The man could have refused to put the vehicle in drive until his passenger put on his seat belt...I've actually known people to do such a thing.

I ensure everyone that rides with me is wearing a seat belt at all times. If they choose not to, they don't ride. I am responsible for them, so I have to cover my ass...know what I mean?

I could see civil liability, but not criminal charges unless the driver was trying to kill them both.

Shouldn't there be some personal responsibility for choosing to ride with a bad driver. My wife and I have a "friend" who was an absolute terror behind the wheel, not young either. My wife made her pull over on the road and drop her off and called me to pick her up due to poor driving and that was the last time either of us ever road with her again.

Write this question down. This applies to sooooooooooooooooo many situations in today's society. I (my opinion, forgot where I was and that I would not be asked for a link:cool:) feel it it ties in with welfare issues, government problems and public education, good Samaritans being sued and this case.

Exactly! You think the passenger should be "held accountable". Why shouldn't the driver be held accountable for what they've done? Someone was killed by their driving, why shouldn't they be held accountable?

Actually my psuedo neice Jordan was in the wreck on 7 highway where the kids were hill jumping. She was the only wearing a seatbelt and the ONLY one who did not get hurt. The 2 males in the car are now paralyzed and her friend was in a coma because she fleww threw the windshield and hit a tree. People make their own choices by not wearing seatbelts but the driver was being wreckless and stupid and should get in trouble for that.

If the driver was doing anything at all stupid, then they damn well deserve to be charged. If you are going to drive like an idiot, do it when you cant take someone else with you.

Was that the wreck on Bundshu and 7? For privacy reasons I won't mention any names but I know there was a wreck on Nov. 21 in which 1 girl was ejected and hit a tree and is suppose to be getting out of the hospital soon, 1 boy was paralyzed, one broke his back and one I'll call "T" broke his back and neck. Actually just saw "T" a week ago (still in a neck and backbrace) and although it's been a long rough road for each of them I think it was a pretty good wake up call. "T" seems to have a bit of a different outlook on things and I hope each of them can find something positive about their experience as he has.

That would be the same one. I think all of them have a different outlook now.
